Legislation Details
- Amends title 40, United States Code, to allow for exceptions to the mileage limitation for Appalachian development highway system projects.
- Renames and reorganizes existing sections of the law for clarity.
- Introduces a process by which the Appalachian Regional Commission can approve waivers for the mileage limitation if the final alignment of a route, determined through the National Environmental Policy Act documentation process, exceeds the established limits.
- Allows any mileage approved beyond the limitation through a waiver to be added to the overall mileage limitation and considered eligible development highway system miles.
- Requires states seeking a waiver to submit an application to the Appalachian Regional Commission with specified information as required by the Commission.
