Legislation Details

Prohibits the Department of State from procuring certain batteries starting October 1, 2027.
Funds appropriated for the Department of State cannot be used to procure batteries from specified entities.
The specified entities include:
- Contemporary Amperex Technology Company, Limited (CATL)
- BYD Company, Limited
- Envision Energy, Limited
- EVE Energy Company, Limited
- Gotion High Tech Company, Limited
- Hithium Energy Storage Technology Company, Limited
- Any successors to the listed entities.
A battery is considered produced by a specified entity if that entity assembles or manufactures the final product or provides a majority of its components.
The Secretary of State can waive the procurement prohibition if it is deemed important to U.S. national interests, with a requirement to submit a written determination and detailed explanation to relevant congressional committees.
