Legislation Details

Amends the United States Sentencing Guidelines specifically for human smuggling offenses.
Introduces a structured increase in sentencing levels based on the number of unlawful aliens smuggled, transported, or harbored:
- 2-4 aliens: add 2 levels
- 5-9 aliens: add 4 levels
- 10-19 aliens: add 5 levels
- 20-29 aliens: add 6 levels
- 30-49 aliens: add 8 levels
- 50 or more aliens: add 10 levels
Establishes increased sentencing levels based on the severity of injury or death resulting from the offense:
- Bodily Injury: add 2 levels for each injured person
- Serious Bodily Injury: add 4 levels for each injured person
- Permanent or Life-Threatening Bodily Injury: add 6 levels for each injured person
- Death: add 10 levels for each deceased person
Limits the cumulative offense level to a maximum of 29, unless certain conditions apply, which could raise it to a maximum of 38.
Adds a note to the commentary indicating that the offense involves injury to, or the death of, a substantial number of individuals.
