Legislation Details

  • Amends the Lacey Act Amendments of 1981 to include a definition for “prohibited primate species,” which encompasses any live species of nonhuman primates such as chimpanzees, gorillas, lemurs, and others, including hybrids.
  • Makes it unlawful to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce, or to breed or possess any prohibited wildlife species or prohibited primate species, with certain exceptions.
  • Specifies exceptions for certain entities or individuals, including those with custody for transport purposes, those in possession of prohibited species born before the enactment of this Act if they register the animal, do not breed or sell, and prevent public contact, and research facilities conducting research with registered prohibited primate species.
  • Requires the Secretary of the Interior to promulgate regulations implementing these amendments within 180 days of the Act’s enactment, stating that the enforceability of these amendments is not dependent on the timely promulgation of these regulations.
  • Includes technical amendments to correct typographical errors and update references within the Lacey Act Amendments of 1981, such as correcting “subpenas” to “subpoenas” and updating the reference to the Magnuson-Stevens Fishery Conservation and Management Act.
