Amends the Help America Vote Act of 2002 to confirm access for designated congressional election observers during federal elections.
Establishes that Congress has the constitutional authority to send observers to polling locations and other election-related processes.
Requires states to provide designated congressional election observers with full access to observe all election administration procedures.
Prohibits observers from handling ballots or election equipment, advocating for candidates, or interfering with the election process.
Allows observers to ask questions of election officials without interfering with the election process.
Provides a process for the removal of observers if they engage in intimidation or disruptive practices, with a requirement to notify congressional committees within 24 hours.
Allows for the replacement of removed observers by congressional committee members.
Defines “designated congressional election observer” as a House or Senate employee designated by committee leadership to gather information related to elections.
Expands the definition of “State” to include all U.S. territories and jurisdictions.
