Amends the Public Health Service Act to eliminate the liability shield for vaccine manufacturers.
Allows individuals to file civil actions against vaccine administrators or manufacturers for vaccine-related injuries or deaths, regardless of whether they have filed a petition for compensation under the National Vaccine Injury Compensation Program.
Repeals certain provisions related to the National Vaccine Injury Compensation Program, including the election to file a civil action and standards of responsibility.
Removes time limitations for filing petitions for compensation related to vaccine injuries or deaths, allowing petitions to be filed at any time unless a civil action has been initiated.
Excludes COVID-19 vaccines from the definition of “covered countermeasure,” which affects liability protections under the Public Health Service Act.
