Legislation Details

  • Establishes the “Fighting Foreign Influence Act” to address foreign contributions and influence in various sectors.

    Title I: Think Tank and Nonprofit Foreign Influence Disclosure

    • Mandates annual disclosure of contributions over $50,000 from foreign governments and political parties by certain tax-exempt organizations.
    • Requires the IRS to publicly disclose the names of contributing foreign governments or political parties and the aggregate amount of their contributions.
    • Applies to returns filed for taxable years beginning after the enactment of the Act.

    Title II: Congressional and Executive Foreign Lobbying Ban

    • Prohibits former Members of Congress, senior political appointees, and general or flag officers of the Armed Forces from registering as agents of foreign principals.
    • Amends the Foreign Agents Registration Act of 1938 and title 18, United States Code, to enforce these prohibitions.
    • Applies to individuals whose service terminates on or after the enactment of the Act.

    Title III: Stop Foreign Donations Affecting Our Elections

    • Requires disclosure of the credit verification value (CVV) for online credit card contributions to federal elections.
    • Stipulates that political committees cannot accept internet credit card contributions without verifying the contributor’s billing address in the U.S. or, for U.S. nationals/lawful permanent residents living abroad, additional identification.
    • Prohibits individuals required to register as agents of foreign principals from delivering contributions to federal candidates or being credited for raising contributions.
    • Defines “deliver” in the context of contributions to include physical or electronic transmission.
    • The amendments related to online contributions and the prohibition on foreign agents delivering contributions apply to contributions made after specified periods post-enactment of the Act.
