Amends title 28 of the United States Code to limit presidential control over investigations involving the President by the Department of Justice.
Introduces a new section (Sec. 530E) regarding presidential oversight of the Attorney General in cases of criminal prosecution against the President.
Requires the Attorney General to submit a sworn statement if the government seeks to dismiss a prosecution against the President, confirming whether the dismissal was ordered by the President or their designee.
Courts must consider the sworn statement and any evidence suggesting that the dismissal is motivated by bad faith or is a pretext for the President to act outside their legal authority before granting dismissal.
Evidence may include whether the dismissal was suggested or ordered by the President and whether the Attorney General was appointed for their willingness to dismiss such prosecutions.
Mandates that any dismissal action be heard by a three-judge court.
Allows courts to impose sanctions if a dismissal motion is found to lack good cause.
Requires the Inspector General of the Department of Justice to report to Congress if there is a good faith basis to believe a dismissal motion was directed by the President or their designee.
