Amends title 18, United States Code, to introduce penalties for crimes targeting law enforcement officers.
Establishes a maximum imprisonment of 10 years, a fine, or both for knowingly assaulting a law enforcement officer causing serious bodily injury or attempting to do so.
Imposes a penalty of imprisonment for any term of years or for life, a fine, or both if the assault results in death, includes kidnapping or an attempt to kidnap, or an attempt to kill.
Specifies circumstances under which these penalties apply, including if the conduct occurs across state lines or national borders, involves the use of interstate or foreign commerce channels, employs a weapon that has traveled in interstate or foreign commerce, interferes with economic activity, affects interstate or foreign commerce, or if the victim is a Federal law enforcement officer.
Requires a written certification from the Attorney General or a designee for the prosecution of any offense described in the section, under certain conditions such as the state not having jurisdiction, the state requesting federal jurisdiction, the state verdict or sentence leaving unvindicated the federal interest in public safety, or if a federal prosecution is deemed in the public interest and necessary for justice.
Defines “law enforcement officer” as an employee of a governmental or public agency authorized to engage in or supervise the prevention, detection, investigation, detention, or incarceration of any person for criminal violations of law.
Defines “State” as a State of the United States, the District of Columbia, or any commonwealth, territory, or possession of the United States.
