Amends chapter 71 of title 5, United States Code.
Requires federal agencies to charge labor organizations fees for the use of agency resources and employee time.
Fees are calculated quarterly based on:
The value of union time for labor representatives.
The value of agency resources provided for union use.
Agencies must notify labor organizations of the fee amount within 30 days after the end of each quarter.
Payment is due within 60 days of receiving the notice.
Payments are transferred to the general fund of the Treasury.
Establishes penalties for non-payment, including:
Denial of union time and agency resources after 90 days of non-payment.
Termination of allotments after 180 days.
Potential termination of the labor organization’s certification as the exclusive representative after 380 days.
Requires tracking of union time by labor representatives.
Non-compliance with payment obligations cannot be contested through grievance procedures.
Inspector General evaluations of compliance are mandated every two years.
Defines key terms such as “agency business,” “agency resources,” “labor organization,” and “union time.”
