Directs the Judicial Conference to submit a report within 180 days of enactment.
The report will review and propose amendments to Rule 412 of the Federal Rules of Evidence to:
Further limit the admissibility of evidence regarding an alleged victim’s sexual behavior or predisposition.
Improve privacy protections for admissible evidence related to the alleged victim’s sexual behavior or predisposition.
The report will also review and propose amendments to Rule 26 of the Federal Rules of Civil Procedure to:
Narrow the scope of permissible discovery requests concerning the alleged victim’s private records unless directly relevant to the case.
Establish clearer privacy protections for the alleged victim, including limitations on subsequent disclosures of their private records.
Ensure discovery practices align with Federal law protecting the rights of the alleged victim.
Additionally, the report will review and propose amendments to Rule 16 of the Federal Rules of Criminal Procedure with similar objectives as outlined for Rule 26.
