Legislation Details

Amends title XVIII of the Social Security Act to introduce a cognitive impairment detection benefit under Medicare.
Requires cognitive impairment detection during the Medicare Annual Wellness Visit and Initial Preventive Physical Examination using approved tools from the National Institute on Aging.
Effective date for the cognitive impairment detection benefit is January 1, 2025.
Enhances the national and local coverage determination processes under Medicare, including a requirement for redetermination of coverage every 10 years.
Mandates the Secretary of Health and Human Services to provide explanations for rejected national coverage determination requests within 90 days.
Ensures local coverage determinations are consistent with existing laws and regulations.
Authorizes $1,000,000 for fiscal year 2024 to support these amendments.
Expands Medicare coverage to include external infusion pumps and associated home infusion drugs under specific conditions.
Requires guidance on Medicare payment for remote monitoring devices that utilize artificial intelligence by January 1, 2026.
Clarifies payment requirements for prescription digital therapeutics under Medicare, with guidance to be issued by January 1, 2026.
