SEC. 1. Short title
- This Act may be cited as Dillon’s Law.
SEC. 2. Preference for States that allow trained individuals to administer epinephrine at schools
- (a) In general
- Section 399L(d) of the Public Health Service Act () is amended— 42 U.S.C. 280g(d)
- in paragraph (1)(F)—
- in the subparagraph heading, by striking and inserting ;
- in the heading for clause (ii), by striking and inserting ; and
- (iv) For purposes of this subparagraph, an elementary school or secondary school in a State may treat an individual who is not an employee of the school as being part of the trained personnel of the school if—
- the individual meets the requirements of paragraph (3)(E); and
- the State attorney general reaffirms the certification of the State under subparagraph (G), taking into account the treatment of individuals authorized by this clause.
