SEC. 1. Short title

• This Act may be cited as the Justice for American Victims of Illegal Aliens Act.

SEC. 2. Death penalty aggravating factors

• Section 3592(c) of title 18, United States Code, is amended by inserting after paragraph (16) the following:
  • (17) Illegal alien
    • The defendant is an alien who—
      • came to, entered, or remains in the United States in violation of Federal law; and
      • has been convicted of killing, attempting to kill, or conspiring to kill a United States citizen.
