SEC. 1. Short title
- This Act may be cited as the or the .
SEC. 2. Fluoride in drinking water
- Section 1412(b)(12) of the Safe Drinking Water Act () is amended by adding at the end the following: 42 U.S.C. 300g–1(b)(12)
- (C) Fluoride
- (i) Prior to publishing in the Federal Register a proposed rule to establish the maximum contaminant level goal for fluoride, or, in the national primary drinking water regulation for fluoride, specify the maximum contaminant level for fluoride, the Administrator shall—
- seek to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine to carry out a rapid response evidence review of such proposed rule, which agreement shall specify a timeline of no fewer than 90 days and no more than 180 days for carrying out such rapid response evidence review;
- provide the National Academies of Sciences, Engineering, and Medicine with all data and other information being used to justify such proposed rule; and
- consider the results of any such rapid response evidence review with respect to such proposed rule.
- (ii) The Administrator shall publish in the Federal Register, as a part of any proposed rule under this subparagraph, the entirety of the final report of any rapid response evidence review relating to such proposed rule.
- (iii) The Administrator may use funds otherwise available to the Administrator to carry out this subparagraph.
