SEC. 1. Short title
- This Act may be cited as the or the .
SEC. 2. Repeal of waivers of State standards
- (a) In general
- Section 209 of the Clean Air Act () is amended— 42 U.S.C. 7543
- by striking subsection (b);
- in subsection (c), by striking the last sentence;
- by redesignating subsections (c) and (d) as subsections (b) and (c), respectively; and
- (d) Prohibition on certain state standards for nonroad engines or vehicles
- No State or any political subdivision thereof shall adopt or attempt to enforce any standard or other requirement that directly or indirectly relates to the control of emissions from nonroad engines or nonroad vehicles, including the following new nonroad engines or nonroad vehicles subject to regulation under this Act:
- New engines that are used in construction equipment, construction vehicles, farm equipment, or farm vehicles.
- New locomotives or new engines used in locomotives.
- No State or any political subdivision thereof shall adopt or attempt to enforce any standard or other requirement that directly or indirectly relates to the control of emissions from nonroad engines or nonroad vehicles, including the following new nonroad engines or nonroad vehicles subject to regulation under this Act:
- (d) Prohibition on certain state standards for nonroad engines or vehicles
- by striking subsection (e) and inserting the following:
- Section 209 of the Clean Air Act () is amended— 42 U.S.C. 7543
- (b) Effect
- Notwithstanding any other provision of law, as of the date of enactment of this Act—
- no waiver issued under subsection (b) of section 209 of the Clean Air Act () (as in effect on the day before the date of enactment of this Act) before the date of enactment of this Act shall have any force or effect; and 42 U.S.C. 7543
- any application for a waiver under that subsection (as in effect on the day before the date of enactment of this Act) pending before the Administrator of the Environmental Protection Agency on the date of enactment of this Act shall be considered denied.
- Notwithstanding any other provision of law, as of the date of enactment of this Act—
- (c) Conforming amendments
- Section 202(i)(2)(A) of the Clean Air Act () is amended, in the matter preceding clause (i), in the first sentence, by striking . 42 U.S.C. 7521(i)(2)(A)
- Section 211 of the Clean Air Act () is amended— 42 U.S.C. 7545
- in subsection (c)(4)—
- (i) in subparagraph (A), in the matter preceding clause (i), by striking ;
- (ii) by striking subparagraph (B); and
- (iii) by redesignating subparagraph (C) as subparagraph (B);
- in subsection (k)(1)(B)(ii), by striking ; and
- in subsection (o)(6)—
- (i) by striking subparagraph (E);
- (ii) in subparagraph (F), by striking ; and
- (iii) by redesignating subparagraph (F) as subparagraph (E).
- in subsection (c)(4)—
- Section 241(2) of the Clean Air Act ( is amended, in the second sentence, by striking and all that follows through . 42 U.S.C. 7581(2)
- Section 242(b) of the Clean Air Act () is amended by striking each place it appears. 42 U.S.C. 7582(b)

SEC. 3. Repeal of authorization to use California new motor vehicle emission standards
