This bill would stop the federal government from spending money to carry out an FDA rule about “Laboratory Developed Tests” (LDTs). That FDA rule says these lab-made tests should be treated like medical devices and regulated by the FDA, with only limited exceptions. Before the rule, the FDA mostly chose when to regulate these tests. By blocking funds, the bill aims to pause or prevent the FDA from enforcing that rule, or anything very similar to it (the rule was published May 6, 2024) .
In everyday terms, this could mean hospitals and testing labs would not face the new FDA oversight from that rule, at least while federal money can’t be used to enforce it.
