FMCSA requests public comment on an application from R.B. Stewart Petroleum Products, Inc., USDOT No. 1290158, (R.B. Stewart) for an exemption from the requirement that lighting devices be steady burning. The exemption would allow the company to operate commercial motor vehicles (CMVs) equipped with a module manufactured by Intellistop, Inc. (Intellistop) which pulses the rear clearance, identification, and brake lamps from low-level lighting intensity to high-level lighting intensity 4 times in 2 seconds when the brakes are applied, and then return the lights to a steady-burning state while the brakes remain engaged. FMCSA requests public comment on the applicant's request for exemption.

Hours of Service of Drivers: Association of American Railroads and American Short Line and Regional Railroad Association; Application for Exemption Renewal

FMCSA announces its final decision to renew and modify the exemption granted to the Association of American Railroads and the American Short Line and Regional Railroad Association and member railroads (the Associations) from the hours-of-service (HOS) prohibitions against driving after the 14th hour after coming on duty (the 14-hour rule) and against driving after accumulating 60 hours of on duty time within 7 consecutive days, or 70 hours of on duty time within 8 consecutive days (the 60-hour/70-hour rule). The exemption will enable covered drivers to respond to unplanned events that occur outside of, or extend beyond, their normal work hours. FMCSA modifies the previous exemption to limit the categories of unplanned events during which the exemption may be used and to add reporting requirements. In addition, only drivers operating for motor carriers listed in the Appendix to this decision may operate under the exemption. FMCSA has analyzed the exemption application and has determined that the exemption renewal, subject to the terms and conditions set forth below, is likely to achieve a level of safety that is equivalent to or greater than the level that would be achieved in the absence of the exemption.

Parts and Accessories Necessary for Safe Operation; Application for an Exemption From Grote Industries, LLC

This notice advises the public of new information that FMCSA believes is relevant to the application from Grote Industries, LLC (Grote) for an exemption from the requirement that exterior lighting devices on commercial motor vehicles (CMVs) be steady-burning. If granted, the exemption would allow motor carriers to operate CMVs equipped with auxiliary warning lamps controlled by Grote's Rear-End Collision Warning (RCW) system. Following publication of the Agency's notice seeking comment, Grote provided additional information to FMCSA staff concerning the design and operation of the RCW system, including the color and activation sequence of the auxiliary warning lamps, the interaction between the RCW and brake-activated warning functions, system operation on combination vehicles, and the operation of the radar detection system. FMCSA is making this supplemental information available in the docket and provides an opportunity for public comment.
