Spring Valley II Solar Final Environmental Impact Statement

The Tennessee Valley Authority (TVA) has decided to adopt the preferred alternative identified in its final environmental impact statement (Final EIS; Document ID EISX-455-00-000-1729685609) for the Spring Valley II Solar Project. The Final EIS was made available to the public on December 19, 2025. A Notice of Availability (NOA) of the Final EIS was published in the Federal Register on January 2, 2026 (91 FR 1). TVA's preferred alternative, analyzed in the Final EIS as the Proposed Action Alternative, consists of TVA executing a power purchase agreement (PPA) with Spring Valley Solar, LLC (Spring Valley Solar), a wholly owned subsidiary of Urban Grid, to purchase power generated by an approximately 200-megawatt (MW) alternating current (AC) solar photovoltaic (PV) facility, which would occupy approximately 740 acres of a 2,426-acre Project Site, in Colbert County, Alabama, south of the city limits of Tuscumbia, Alabama, near the City of Muscle Shoals and Florence, Alabama, along US Highway 43. To interconnect to TVA's existing electrical grid Spring Valley Solar, LLC, would build a new onsite 161-kV substation and install network upgrades to the nearby transmission lines (TL). This alternative would achieve the purpose and need of the Project to meet the energy needs in response to customer demands and aligns with TVA's 2019 Integrated Resource Plan (IRP).

Agency Information Collection Activities: Proposed Collection; Comment Request

Pursuant to the Paperwork Reduction Act of 1995, the Tennessee Valley Authority (TVA) will be requesting from the Office of Management and Budget (OMB) review of TVA's Generic Clearance for the collection of qualitative feedback on agency service delivery, community engagement, and usability testing. This Generic Clearance will fast- track the process for TVA to seek feedback and input from the public, through surveys and other instruments, regarding TVA services and programs as well as community needs and concerns. The clearance will also allow the collection of registration information for public forums, events, and other opportunities for public engagement.

Implementation of the National Environmental Policy Act

This interim final rule revises the Tennessee Valley Authority (TVA) procedures implementing the National Environmental Policy Act (NEPA). TVA is taking this action in response to the amendments to NEPA enacted through the Fiscal Responsibility Act of 2023 and the One Big Beautiful Bill Act of 2025, to reflect the Supreme Court's recent decision in Seven County Infrastructure Coalition v. Eagle County, Colorado, and to align with Executive Order (E.O.) 14154, Unleashing American Energy, and the Council on Environmental Quality's (CEQ) subsequent recission of its NEPA implementing regulations, which TVA's procedures were intended to supplement. This interim final rule requests comments on this action and TVA's intent to move its procedures at Subpart G, for compliance with E.O. 11988, Floodplain Management, and E.O. 11990, Protection of Wetlands, into a new part 1319 of the CFR, to inform TVA's decision-making.
