H.R. 8473.
Congress has the power to enact this legislation pursuant
to the following:
Congress has the power to enact this legislation pursuant
to the following provisions of the Constitution of the United
States:
Article I, Section 8, Clause 3 (the Commerce Clause), which
grants Congress the authority to regulate commerce with
foreign nations, among the several States, and with Indian
Tribes, including matters affecting public health, zoonotic
disease prevention, and interstate disease transmission.
Article I, Section 8, Clause 1 (the Spending Clause), which
grants Congress the authority to provide for the general
welfare of the United States through expenditures for public
health and Indian health programs.
Article I, Section 8, Clause 18 (the Necessary and Proper
Clause), which authorizes Congress to make all laws necessary
and proper for carrying into execution the foregoing powers,
including legislation relating to the Indian Health Service,
public health veterinary services, and coordination among
Federal agencies.
Article I, Section 8, Clause 3 (the Indian Commerce Clause)
and Article IV, Section 3, Clause 2 (the Property Clause)
further provide authority for legislation concerning Indian
Tribes and Federal responsibilities in Tribal and Federal
lands and communities.
