Congress has the power to enact this legislation pursuant
to the following:
Congress has the authority to enact this legislation
pursuant to Article I, Section 8 of the United States
Constitution, including:
The Spending Clause (Clause 1), which grants Congress the
power to provide for the general welfare of the United States
by authorizing federal funding and grant programs to support
school security improvements; and
The Commerce Clause (Clause 3), which grants Congress the
power to regulate interstate commerce, including matters that
substantially affect interstate commerce such as public
safety, education systems, and the movement of personnel and
goods related to school security.
