At the appropriate place, insert the following:
SEC. . DEFINITION OF FOREIGN INSTRUMENTALITY FOR PURPOSES
OF ECONOMIC ESPIONAGE PROHIBITION.
Section 1839(1) of title 18, United States Code, is
amended—
(1) by striking “that is substantially owned” and
inserting the following: “that is—
“(A) substantially owned”; and
(2) by adding at the end the following: “or
“(B) domiciled in a covered nation, as defined in section
4872 of title 10;”.
