Mr. DURBIN (for himself and Ms. Duckworth) submitted an amendment intended to be proposed by him to the bill S. 4784, to authorize appropriations for fiscal year 2027 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table; as follows:
At the end of subtitle D of title X, add the following:
SEC. 1037. PROHIBITION ON FUNDING FOR ACTIVITIES THAT WOULD
VIOLATE THE POSSE COMITATUS ACT OR INFRINGE ON
POWERS RESERVED TO THE STATES.
None of the funds authorized to be appropriated by this Act
for the Department of Defense may be used for, or in support
of, any activities that would violate section 1385 of title
18, United States Code (commonly known as the “Posse
Comitatus Act”), or infringe on powers reserved to the
States under the Constitution of the United States.
