Congress has the power to enact this legislation pursuant
to the following:
Congress has the power to enact this legislation pursuant
to Article I, Section 8, Clause 1 of the United States
Constitution, which grants Congress the power to lay and
collect taxes to pay the debts and provide for the common
defense and general welfare of the United States, including
the authority to attach conditions to the receipt of federal
funds. This authority is further supported by Article I,
Section 8, Clause 18, which grants Congress the power to make
all laws necessary and proper for carrying into execution its
enumerated powers, including its authority over federal
spending and grant programs administered by the Department of
Justice.
