Legislation Details

Imposes additional duties on imports of green energy goods from the People’s Republic of China to establish energy independence for the United States.
Finds that China dominates the global production of green energy goods and that U.S. climate change policies increase dependence on China for energy needs.
Defines terms related to green energy components and goods, including battery cells, photovoltaic cells, and wind energy components.
Requires the United States International Trade Commission to publish an annual list detailing the volume and value of green energy components produced in the U.S. and imported from China and other countries.
Sets the initial duty rate on Chinese green energy goods at 25 percent ad valorem, increasing by 5 percent annually until reaching a maximum rate 5 years after enactment.
Specifies the criteria for determining whether a green energy good originates in China, including production location and control by Chinese entities.
States that duties on Chinese green energy goods are in addition to any other applicable duties and prohibits the use of emergency authority to import these goods duty-free.
Mandates the United States Trade Representative to report on industrial subsidies provided by the Chinese government to its battery, solar energy, and wind energy sectors within the last 15 years, including direct transfers of funds, tax incentives, and preferential treatment.
