The legislation is titled the "Early Participation in Regulations Act of 2024."
It amends Subchapter II of chapter 5 of title 5, United States Code, to include definitions for "major rule" and "Office of Information and Regulatory Affairs."
A "major rule" is defined as any rule likely to have a significant economic impact, affect costs or prices significantly, or have significant effects on various economic and environmental factors.
The "Office of Information and Regulatory Affairs" is defined as the office established under section 3503 of title 44, including any successors.
Agencies are required to publish an advance notice of proposed rulemaking for major rules in the Federal Register at least 90 days before publishing a notice of proposed rulemaking.
The advance notice must include a written statement identifying the problem the rule addresses, regulatory alternatives under consideration, and the legal authority for the rule. It must also solicit feedback and provide at least 30 days for public comment.
Exceptions to the advance notice requirement include situations where it is not in the public interest, would be duplicative or unnecessary for public participation, not practicable due to deadlines, or if the rule is routine or periodic in nature.
Decisions by the Administrator of the Office of Information and Regulatory Affairs regarding exceptions are not subject to judicial review.
Any discrepancies between the policies in the advance notice and the proposed rulemaking are not reviewable under section 706(2)(A).
