Amends the Export Control Reform Act of 2018 to prevent foreign adversaries from exploiting U.S. artificial intelligence (AI) and other enabling technologies.
Introduces the “Enhancing National Frameworks for Overseas Restriction of Critical Exports Act” or “ENFORCE Act”.
Defines terms related to artificial intelligence, including “artificial intelligence,” “artificial intelligence system,” and “covered artificial intelligence system.”
Provides an interim definition for “covered artificial intelligence system” that includes AI systems capable of posing a serious risk to U.S. national security and foreign policy, specifically mentioning capabilities related to chemical, biological, radiological, or nuclear weapons, offensive cyber operations, and evasion of human control.
Requires the Secretary, in consultation with other key departments, to issue regulations defining “covered artificial intelligence system” within 365 days, with the ability to update this definition as necessary.
Grants the President authority to control U.S. persons’ activities related to specific covered AI systems and emerging and foundational technologies identified as essential to national security.
Allows the President to require U.S. persons to obtain a license for exporting, reexporting, or transferring items, including those not currently under control, that support the design, development, or production of covered AI systems or specific emerging and foundational technologies.
Amends the International Emergency Economic Powers Act to replace references to the Export Administration Act of 1979 with references to the Export Control Reform Act of 2018, specifically section 1754.
