Legislation Details

Amends title XI of the Social Security Act to allow for the redistribution of unused Medicaid funds among U.S. territories.
Establishes a procedure for increasing Medicaid funding limits for territories that did not use their full allocation, referred to as “shortfall territories.”
Specifies that for each fiscal year starting with 2022, if any territory has unused Medicaid funds, those funds can be redistributed to territories that exceeded their funding limits.
The amount redistributed to each shortfall territory depends on whether the total unused funds exceed the total needed to cover all shortfalls. If so, each shortfall territory receives funds up to their full shortfall amount. If not, funds are distributed proportionally based on each territory’s shortfall.
Allows for retrospective adjustments based on reported information by territories after the fiscal year ends.
Clarifies that any increase in funding for a territory in a given fiscal year due to this redistribution does not affect the funding limit for that territory in the following fiscal year.
Defines key terms used in the legislation, including “shortfall amount,” “shortfall territory,” “specified territory” (the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa), and “unused amount.”
This act is titled the “Ensuring Medicaid Continuity for the Insular Areas Act of 2024.”
