Legislation Details

Amends title 5 of the United States Code to prohibit senior federal officials from accepting foreign emoluments without congressional consent.
Defines “senior federal official” to include the President, Vice President, Members of Congress, heads of executive departments, and other designated senior employees.
Establishes a requirement for senior federal officials to obtain consent from Congress before receiving foreign payments, both during their term and for two years post-employment.
Mandates that candidates for President or Vice President report any foreign payments received while campaigning.
Requires written notice to the Director of the Office of Government Ethics before accepting foreign payments, detailing the payment and confirming no solicitation was made.
Congress must review and consent to foreign payments through a concurrent resolution within a specified timeframe.
Outlines penalties for violations, including civil and criminal penalties, forfeiture of payments, and civil actions by private individuals.
Grants the Office of Government Ethics authority to enforce compliance and develop regulations related to foreign payments.
Includes provisions for disclosures regarding foreign payments in annual reports by senior federal officials.
Contains a severability clause to ensure that if any part of the legislation is found unconstitutional, the rest remains in effect.
