Legislation Details

Reauthorizes Title VII of the Foreign Intelligence Surveillance Act (FISA) for five years.
Implements changes to FISA, including restrictions on surveillance under Section 702.
Statutory limits on querying the contents of information collected under Section 702 are established.
Prohibits FBI personnel from making U.S. person queries without prior approval by certain FBI supervisors or attorneys, except in cases of threats to life or serious bodily harm.
Requires FBI Deputy Director to approve politically sensitive query terms.
Prohibits political appointees from being involved in the approval process for politically sensitive queries.
Mandates the FBI Director to establish consequences for noncompliant querying of U.S. person terms, with a zero tolerance policy for willful misconduct.
Surveillance order applications under FISA must be supported by sworn statements and limit the use of information derived from political organizations or media sources.
Increases criminal penalties related to FISA violations.
Requires adverse consequences, such as suspension without pay or removal, for government officers and employees who engage in intentional misconduct in proceedings before the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review.
