Legislation Details

The legislation proposes the abolition of the Department of Education effective 180 days after enactment.
All programs under the Department of Education, except those specified for transfer, will be repealed.
Certain programs and functions will be transferred to other federal departments:
- Individuals with Disabilities Education Act functions to the Department of Health and Human Services.
- Office of Indian Education programs to the Department of the Interior.
- Various education funding programs (e.g., Pell Grants, Federal Family Education Loans) to the Department of the Treasury.
Establishes a block grant program for states to support elementary, secondary, and postsecondary education, administered by the Secretary of the Treasury.
Allocations to states will be based on student enrollment numbers from the previous fiscal year.
States receiving block grants must submit annual student data, complete audits, and comply with federal civil rights laws.
The legislation includes provisions for addressing misused or misappropriated funds by states.
The Civil Rights Division of the Department of Justice will enforce applicable federal civil rights laws related to the grant programs established under this legislation.
