Legislation Details

The legislation aims to add the Republic of Korea to the E3 nonimmigrant visa program.
It amends the Immigration and Nationality Act to include nationals of the Republic of Korea in the E3 visa category, based on reciprocity and agreements determined by the Secretary of State.
Employers hiring nationals from the Republic of Korea under this program must participate in the E-Verify program during the employment period.
The legislation specifies application allocation for E3 visas, allowing up to 10,500 visas for Australian nationals and a number for Korean nationals equal to the difference between 10,500 and the number of Australian applications approved in the previous fiscal year.
The approval of applications for Korean nationals will be considered to have occurred on September 30 of the prior fiscal year for numerical control purposes.
The Act will take effect 180 days after its enactment.
