Prohibits the unauthorized use of another person’s identity to make available certain information on interactive computer services.
Applies to providers of interactive computer services, overriding certain protections under the Communications Act of 1934.
Allows individuals to bring civil actions against violators in U.S. district courts.
If the plaintiff prevails, they may receive:
Actual damages.
Injunctive relief requiring the service provider to disclose the true source of the information.
Reasonable attorney fees and litigation costs.
Defines “covered information” as libelous, slanderous, or criminal information presented under another person’s identity without authorization.
Includes definitions for “information content provider” and “interactive computer service” as per the Communications Act of 1934.
