Legislation Details

Prohibits the Secretary of Health and Human Services from finalizing, implementing, or enforcing a specific portion of a proposed rule by the Centers for Medicare & Medicaid Services.
The rule in question is titled “Medicaid Program; Ensuring Access to Medicaid Services” and was proposed on May 3, 2023.
Specifically targets the proposed requirement that at least 80% of all payments made under a State plan for Medicaid with respect to homemaker services, home health aide services, and personal care services under a waiver must be spent on compensation for direct care workers.
Also prohibits the creation, implementation, enforcement, or effect of any similar rule that mandates a minimum percentage of payments for these services to be allocated towards compensation for direct care workers.
