Temporarily suspends duties on imports of titanium sponge classified under subheading 8108.20.00 of the Harmonized Tariff Schedule.
The duty-free period begins 30 days after enactment and ends on December 31, 2031, or when the President terminates the duty-free treatment.
Exceptions to the duty suspension apply to imports from Belarus, Cuba, North Korea, and the Russian Federation, which will continue to incur the previous duty rate.
The President is required to assess the sufficiency of domestic titanium sponge production for national security needs every three years and annually thereafter.
A 60-day consultation period is mandated for stakeholders to provide input before the President’s determination.
If the President finds domestic production sufficient, the duty-free treatment will be terminated one year after the determination.
The President has the authority to increase duties on titanium sponge based on market and security conditions, considering factors such as import trends, domestic production changes, employment trends, and national security impacts.
Any increase in duties cannot exceed the bound rate established by the United States’ commitments as a World Trade Organization member.
