The bill substantially strengthens whistleblower protections, oversight, and clarity around federal NDAs—benefiting employees, contractors, and public accountability—while imposing meaningful administrative costs, litigation risks, and potential challenges for protecting legitimately sensitive information and agency operations.
Federal employees and government contractors gain clear, statutory protection to make whistleblower disclosures (to Congress, OSC, IGs, GAO, MSPB, and courts) without fear of NDA-based discipline or enforcement.
Federal employees can obtain faster, meaningful remedies — sue to enjoin retaliatory NDA enforcement, recover lost wages/benefits and attorney fees, and avoid administrative-exhaustion delays — improving access to redress.
OSC review and a published registry (plus OPM template requirements) create centralized review and uniformity: NDAs that are not OSC-certified are void, reducing abusive or ambiguous secrecy clauses and giving agencies/contractors clearer standards.
All federal agencies, and contractors in many cases, will face substantial administrative and compliance costs to revise NDA templates, update onboarding paperwork, conduct trainings, and maintain required filings and registries.
The bill will likely increase litigation (suits to enjoin enforcement, damages awards, attorney-fee recoveries, and challenges to notices), raising legal costs for agencies and taxpayers and creating operational uncertainty.
Limiting enforceability of many NDA terms and lowering barriers to suits could create national-security and confidentiality risks if legitimately sensitive information is mishandled or enforcement of secrecy rules becomes harder.

Official title: To limit the use of nondisclosure agreements that restrict whistleblowing by Federal employees and contractors, and for other purposes.
Introduced August 31, 2026 by Eugene Simon Vindman · Last progress August 31, 2026
Prohibits federal agencies from using nondisclosure agreements (NDAs) to block or chill legally protected whistleblower disclosures and requires agencies to give clear, plain-language notice of protected disclosure rights in any NDA. It creates review and certification requirements for NDA templates (OSC and agency Inspectors General), a public registry, civil penalties for noncompliance, a federal private right of action for retaliatory NDA enforcement, and protections for Inspectors General who report noncompliant NDAs. The law takes effect on enactment, with a 180‑day transition for existing NDAs to be made compliant; agencies must submit NDA templates for OSC review, include a clear “YOUR PROTECTED DISCLOSURE RIGHTS” rider in covered NDAs, and face specified remedies, reporting, audits, and penalties if they attempt to enforce NDAs against protected disclosures.
