Speeds up decisions on requests to use Federal property for telecom/broadband infrastructure by setting clear rules for when an application is complete and when the decision clock starts. If an agency fails to approve or deny a complete application by the deadline set in law, the application is automatically approved the next day. Defines “complete” (including a 30‑day notice rule for agencies to flag missing items) and clarifies when a complete application is considered received. The goal is to reduce delays and give applicants predictable timelines for building communications facilities on Federal land and rights‑of‑way.
Replace the term "duly filed" with the term "complete" in subparagraph (A) of 47 U.S.C. 1455(b)(3).
Add a new subparagraph (E) that provides: if an executive agency fails to grant or deny a complete application by the deadline under subparagraph (A), the application is deemed granted on the day after that deadline.
Add a new subparagraph (F)(i) defining when an application is considered "complete": the applicant must (I) have taken the first procedural step within the applicant's control to submit the application according to the agency's procedures, and (II) must not have received a written notice from the executive agency within 30 days after the date the application is received by the agency.
Add a new subparagraph (F)(ii) defining when a complete application is considered "received": (I) generally on the date the applicant submits all information required by the executive agency to be considered complete; or (II) if not all information was submitted but the application is treated as complete under clause (i) because the agency did not send a written notice within the 30-day period, then the application is considered received on the day after the last day of that period.
State that the amendments apply to any application under subsection (b) of section 6409 (47 U.S.C. 1455) that is received by an executive agency on or after the date of enactment of this Act.
