Disapproves and nullifies the Environmental Protection Agency’s approval of South Dakota’s Regional Haze Plan for the second implementation period (90 Fed. Reg. 41893, Aug. 28, 2025), so that EPA action has no force or effect. The resolution would, on enactment, remove the federal approval of that specific air-quality rule and block the Agency from relying on that approval in enforcement or permitting decisions.
This does not create new funding or program authorizations. It primarily changes the legal status of the EPA action, creating regulatory and legal uncertainty for the State of South Dakota, affected industrial sources, public-health stakeholders, Tribal authorities, and EPA implementation activities tied to the plan.
