This bill meaningfully expands who and what illnesses qualify for radiation compensation and boosts payments and studies to help exposed communities — but it raises federal costs, increases administrative complexity, and creates risks of uneven implementation, delays, and evidence gaps.
Millions of current and former radiation‑exposed people — including veterans, downwind communities, territorial residents, and some nuclear workers — gain substantially expanded eligibility (removed age‑at‑exposure limit, shorter residency test, added ZIP/county/cohort routes) and more compensable diseases (explicitly adding renal and thyroid illnesses), plus clearer rules for prior claimants to求补
Qualifying claimants (and survivors) receive larger and more-direct financial relief — a new $50,000 supplemental payment for downwind claimants, fixed survivor payments for deceased claimants' beneficiaries, and reimbursement of documented out‑of‑pocket medical expenses — improving immediate financial security for affected families
Lowered evidentiary barriers and broader filing options (acceptance of sworn affidavits, third‑party statements, authorization for representatives, and procedures accounting for Tribal laws) make it easier for claimants and survivors — including those lacking formal records — to file and obtain compensation
Broad expansions of eligibility, new supplemental payments, reimbursements, retroactive adjustments, and extended benefit lists will materially increase federal compensation payouts and long‑term budgetary obligations
The program will face substantial administrative pressure — more claims, new cohort designations, broadened disease lists, and retroactive payments are likely to lengthen processing times and delay payments for some eligible claimants
Accepting affidavits and broader corroborating evidence increases the risk of fraudulent or inaccurate claims, which could divert funds away from eligible victims and require increased oversight

Official title: To amend the Radiation Exposure Compensation Act to provide for certain claims related to atmospheric testing, and for other purposes.
Introduced August 17, 2026 by James Moylan · Last progress August 17, 2026
Expands and modernizes the Radiation Exposure Compensation Act (RECA) by broadening who may qualify for payments and medical benefits, adding a petition-and-designation process for new claimant cohorts, increasing supplemental awards, and establishing federal studies on historical fallout and health effects. The law also directs NIH and DOE to run short-term research and reporting, funds targeted HRSA grants (including mobile units) for affected regions, and allows previously compensated claimants to request additional payments under the updated rules. Key changes include relaxed residency and age rules for certain claimants, statutory recognition of petition-designated cohorts, explicit reimbursement of out-of-pocket medical expenses for downwind claimants, an expanded list of compensable diseases, expanded ZIP-code and territory coverage (including Guam and additional ZIP codes in several States), and deadlines and procedures for agency reviews and Presidential action on cohort petitions.
