Revising Non-Over-the-Counter Firearms Transaction Requirements

This rule would update the regulations to allow non-over-the-counter (“NOTC”) firearm sales by Federal firearms licensees (“FFLs”) to unlicensed persons residing in the same State as the FFL. These proposed changes would remove restrictions currently limiting this option to solely background check-exempt transfers. The rule also proposes permitting remote identity proofing, remote background checks, and electronic notices to and from chief law enforcement officers in order to satisfy the Gun Control Act’s notification requirements for NOTC transactions. These changes would provide greater flexibility and options for individuals lawfully purchasing firearms.
