Patient Protection and Affordable Care Act, HHS Notice of Benefit and Payment Parameters for 2027; and Basic Health (CMS-9883-P)

This rule proposes updates under the ACA and implements parts of the Working Families Tax Cut legislation. Proposed changes include discontinuing non-standardized plan option limits, deferring network adequacy reviews to States, reducing ECP thresholds, and allowing non-network plans if provider access standards are met. It would set 2027 user fee rates for issuers, require defrayal of State-mandated benefits, strengthen agent/broker standards, expand hardship exemptions, and prohibit routine non-pediatric dental services as EHB. Proposed updates also cover State Exchange Improper Payment Measurement, quality improvement strategies, BHP eligibility, bronze and catastrophic plan viability under actuarial values and MOOP constraints, and multi-year catastrophic plans.
