Nondiscrimination in Federally Assisted Programs of the Department of Defense—Effectuation of Title VI of the Civil Rights Act of 1964; Amendment

This rule amends DoD regulations to eliminate disparate-impact liability. These amendments align DoD’s regulations with the text and original meaning of Title VI and current DoD policy. By reducing regulatory burden, they also minimize compliance costs and ensure appropriate stewardship of taxpayer dollars. Finally, these revisions implement the changes directed in Executive Order 14281. This rule also makes minor technical updates to correct outdated provisions. These revisions also align with changes made by the U.S. Department of Justice (DOJ) to its Title VI Regulations at 28 CFR part 42, effective December 10, 2025. 90 FR 57141.
