Environmental Defense Alliance and Waterkeepers Florida v. Lee M. Zeldin (Case No. 3:25-cv-00930-JEP-MCR)

Plaintiffs and EPA agree that it is in the interest of the parties, public, and judicial economy to resolve this matter without protracted litigation and accordingly intend to resolve the claims identified in Plaintiffs’ complaint through this Consent Decree. On or before December 1, 2026, the EPA Administrator shall sign a final rule promulgating revised and new numeric water quality criteria for priority toxic pollutants in Florida’s surface waters, unless prior to such promulgation the State of Florida has adopted revised and new water quality criteria for priority toxic pollutants which the Administrator determines to be in accordance with the Clean Water Act.
