Prosecutorial Discretion of Enforcement Attorneys

This rule proposes to clarify that enforcement attorneys have discretion to dismiss a technical violation where the challenged conduct does not raise a practical safety issue, consistent with the DOT Memorandum on Procedural Requirements for Enforcement Actions.
