Please find enclosed the following notification from the
Department of State.
Department Notification Number: RSAT 26-II.
Pursuant to the reporting requirements of Section
36(b)(5)(C) of the Arms Export Control Act (AECA), as
amended, we are forwarding Transmittal No. 26-11. This
notification relates to enhancements or upgrades from the
level of sensitivity of technology or capability described in
the Section 36(b)(1)AECA certification 22-25 of 05/11/2022.

REPORT OF ENHANCEMENT OR UPGRADE OF SENSITIVITY OF TECHNOLOGY
OR CAPABILITY (SEC. 36(B)(5)(C), AECA)
(i) Prospective Purchaser: Government of the Netherlands.
(ii) Sec. 36(B)(1), AECA Transmittal No.: 22-25; Date: May
26, 2022; Implementing Agency: Navy.
(iii) Description: On May 26, 2022, Congress was notified
by congressional certification transmittal number 22-25 of
the possible sale, under Section 36(b)(1) of the Arms Export
Control Act, of ninety-five (95) AIM-9X Block II Tactical
Missiles; forty-three (43) AIM-9X Block II+ Tactical
Missiles; and one (1) AIM-9X Block II+ Tactical Guidance
Unit. Also included were containers; classified and
unclassified software; U.S. Government and contractor
technical assistance; and other related elements of
logistical and program support. The total estimated value was
$117 million. Major Defense Equipment (MDE) constituted
$104.6 million of this total.
This transmittal notifies the addition of the following MDE
items: up to three hundred ninety-two (392) AIM-9X Sidewinder
Block II Tactical Missiles. The following nonMDE items will
also be included: additional containers; classified and
unclassified software; transportation; technical assistance;
U.S. Government and contractor technical assistance; and
other related elements of logistical and program support. The
estimated total value of the new items is $295 million. The
estimated MDE value will increase by $269.9 million to a
revised $374.5 million. The estimated non-MDE value will
increase by $25.1 million to a revised $37.5 million. The
estimated total case value will increase by $295 million to a
revised $412 million.
(iv) Significance: This notification accounts for requested
additional MDE and non-MDE items not included in the original
notification. The inclusion of this MDE and non-MDE
represents an increase in capability over what was previously
notified. The proposed articles and services will support the
Netherlands' air defense capability by improving its
capability to conduct self-defense and regional security
missions and enhancing interoperability with the U.S. and
other NATO members.
(v) Justification: This proposed sale will support the
foreign policy and national security objectives of the United
States by improving the security of a NATO Ally which is an
important force for political stability and economic progress
in Europe.
(vi) Sensitivity of Technology:
The Sensitivity of Technology Statement contained in the
original notification applies to items reported here.
The highest level of classification of defense articles,
components, and services included in this potential sale is
SECRET.
