Adds new paragraphs (39) and (40) to 18 U.S.C. 921(a) defining (39) 'convicted in any court of a misdemeanor hate crime' and (40) 'received from any court an enhanced hate crime misdemeanor sentence', including specified elements and exclusions.
Amends the first sentence of 18 U.S.C. 922(d) by inserting a new paragraph (11) disqualifying persons who 'has been convicted in any court of a misdemeanor hate crime, or has received from any court an enhanced hate crime misdemeanor sentence'; strikes and adjusts existing punctuation/wording and redesignates existing paragraph (11) as paragraph (12), and changes a cross-reference from 'through (10)' to 'through (11)'.
Amends 18 U.S.C. 922(g) by inserting after paragraph (9) a new paragraph (10) disqualifying from possession, shipment, or transport a person who 'has been convicted in any court of a misdemeanor hate crime, or has received from any court an enhanced hate crime misdemeanor sentence'; also makes minor punctuation edits to paragraphs (8) and (9).
