Requires special Medicare outpatient payment rules for algorithm-driven clinical services and codifies a hospital outpatient payment policy for software‑as‑a‑service (SaaS). For algorithm-based services beginning Jan 1, 2026, CMS must create a new-technology ambulatory payment classification (APC) based on manufacturer-submitted costs, may adjust classifications as needed, and cannot remove a service from the new-technology APC until sufficient claims data exist and the service has been paid in that APC for at least five years. The bill also requires CMS to apply an OPPS payment policy for SaaS provided on or after Jan 1, 2023.
