Strikes specified language from subsection (i) of 42 U.S.C. 1395p: removes text in the first sentence of paragraph (1) subparagraph (A); removes text in the first sentence of paragraph (2) in subparagraphs (B) and (C); and removes text in paragraph (3)(A).
Amends the second sentence of 42 U.S.C. 1395r(b) by striking the sequence "; and" and inserting additional text immediately before the period at the end of that sentence (specific inserted text not included in this section excerpt).
Amends the first sentence of 42 U.S.C. 1395r(b) to change the Medicare Part B late enrollment penalty calculation from the existing 10% per full 12 months to 15% of the monthly premium calculated for a period equal to twice the number of months in each of the full periods of 12 months.
Makes conforming amendments to section 1818 of the Social Security Act by striking specified text in subsection (c)(6) and replacing specified language in subsection (g)(2)(B). The exact replacement text to be inserted is not provided in this section.
Changes the way the Medicare Part B late‑enrollment penalty is calculated and revises how certain periods of COBRA, retiree, and VA coverage count for enrollment and penalty purposes. It replaces the prior 10% per full 12‑month period rule with a new 15% calculation tied to a longer period, adjusts which months count toward ending a penalty, and removes/edits statutory language about special enrollment for people whose COBRA or retiree coverage ends.
The amendments take effect after a 90‑day period following enactment (with coverage‑termination provisions applied to terminations occurring after that 90‑day window). The changes mainly affect people who delay Part B enrollment and those with COBRA, retiree, or VA coverage, and will require CMS and plan administrators to update procedures and notices.
Referred to the Committee on Energy and Commerce, and in addition to the Committee on Ways and Means, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.
