Adds a new subparagraph (J) to 8 U.S.C. 1182(a)(2) establishing inadmissibility for aliens who, while serving as foreign government officials, were responsible for or directly carried out acts against a U.S. citizen located in the United States that would violate the First Amendment if committed by a U.S. government official.
Adds a new subparagraph (G) to 8 U.S.C. 1227(a)(2) creating deportability for aliens who, while serving as foreign government officials, were responsible for or directly carried out acts against a U.S. citizen located in the United States that would violate the First Amendment if committed by a U.S. government official.
Creates a new immigration ground to bar entry or permit removal of foreign government officials who, while acting in their official capacity, took actions in the United States against a U.S. person that would violate the First Amendment if performed by a U.S. official. In practice, it instructs immigration authorities to deny visas or remove noncitizens who engaged in censorship, intimidation, or similar suppression of free expression on U.S. soil while serving as foreign officials.
Adds a new inadmissibility ground: Any alien who, while serving as a foreign government official, was responsible for or directly carried out any act against a United States citizen located in the United States that, if committed by a United States government official in the United States, would violate the First Amendment, is inadmissible.
Adds a new deportability ground: Any alien who, while serving as a foreign government official, was responsible for or directly carried out any act against a United States citizen located in the United States that, if committed by a United States government official in the United States, would violate the First Amendment, is deportable.
