Changes how the National Labor Relations Board (NLRB) sets the dollar threshold for declining jurisdiction in certain labor disputes by sharply increasing the threshold for 2026 and indexing future thresholds to a per‑capita spending measure. For calendar year 2026 the threshold becomes ten times the amount that applied the day before enactment; thereafter the threshold is updated annually using the Personal Consumption Expenditure (PCE) Per Capita Index published by the Bureau of Economic Analysis (BEA).
The new rule applies to NLRB jurisdiction decisions made on or after January 1, 2026, or the date of enactment if later, and requires the BEA to publish the PCE Per Capita Index annually starting in 2027 to compute future adjustments.
